The effect of legal formalism in the application of law
The project focuses on the analysis of one of the most important, widespread and influential contemporary conceptions of law: legal formalism. This conceptualization of the current law can be understood as the standard theoretical parameter of the law in the nineteenth and twentieth centuries, as politically linked to the liberal and enlighted project and heir to the revolutionary ideals of 1789, as an epistemological expression of the world of translation to the Law of the categories of positivist science, and finally, as a manifestation of the moral model of the judge complying with the law .
